Overview
PLEASE READ THIS TELEHEALTH INFORMED CONSENT ("CONSENT") CAREFULLY BEFORE USING TELEHEALTH SERVICES THROUGH THE KEEN PLATFORM. BY ACCESSING OR USING TELEHEALTH SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE TERMS OF THIS CONSENT.
IF YOU HAVE A MEDICAL EMERGENCY, CALL 911 OR GO TO YOUR NEAREST EMERGENCY ROOM IMMEDIATELY. THE KEEN PLATFORM IS NOT DESIGNED FOR EMERGENCY OR LIFE-THREATENING SITUATIONS.
1. Definitions
1.1 "Keen," "Keen Meds," "we," "us," or "our" refers to Keen, operated by Keen Meds Inc., a Delaware corporation with its principal office at 1550 Wewatta Street, Suite 200, Denver, CO 80202. "Keen" is the brand name under which Keen Meds Inc. operates.
1.2 "Platform" means the Keen website located at livekeen.co, any associated mobile applications, and all related tools, features, and services provided by Keen Meds Inc.
1.3 "Healthcare Provider" or "Clinician" means a licensed medical professional affiliated with our independent medical practice partner who provides telehealth consultations and prescribing services through the Platform.
1.4 "Pharmacy" means our licensed 503A compounding pharmacy partner that compounds, dispenses, and ships prescription medications ordered through the Platform.
The specific medical practice and pharmacy entities are identified in Section 16 (Contact Information) of this Consent.
1.5 "Telehealth Services" means the delivery of healthcare services using electronic communications, information technology, or other means between a Clinician and a patient who are not in the same physical location, including synchronous (real-time audio/video) and asynchronous (store-and-forward messaging) consultations.
1.6 "Member" or "you" refers to any individual who creates an account on the Platform and consents to receive Telehealth Services.
2. About Keen and Our Service Model
2.1 Platform Role. Keen Meds Inc. operates as a technology platform that connects Members with independent healthcare providers and pharmacy services for hormone optimization and related health services. Keen Meds Inc. is NOT a medical practice, does NOT employ physicians, and does NOT practice medicine. All medical decisions, clinical assessments, diagnoses, and prescribing are the sole responsibility of licensed Clinicians affiliated with our medical practice partner.
2.2 Three-Party Service Model. Telehealth Services accessed through the Platform involve three independent entities:
- Keen Meds Inc. provides the technology platform, membership billing, customer support, intake coordination, and product fulfillment logistics.
- Our affiliated medical practice is an independent medical practice that employs or contracts with licensed Clinicians who conduct telehealth consultations, make clinical assessments, and issue prescriptions when clinically appropriate. Our affiliated medical practice is solely responsible for all medical decisions and clinical care.
- Our partner pharmacy is an independent, licensed 503A compounding pharmacy that compounds, verifies, dispenses, and ships prescription medications pursuant to valid, patient-specific prescriptions.
- 3. Nature of Telehealth Services
3.1 Description of Telehealth. Telehealth involves the use of electronic communications to deliver healthcare services when the patient and healthcare provider are not in the same physical location. Electronic communications may include secure messaging, health intake questionnaires, audio calls, video conferencing, and the transmission of medical records, images, and laboratory results.
3.2 Scope of Services. Telehealth Services provided through the Platform include, but are not limited to:
- Initial medical consultations conducted via asynchronous messaging, audio, or video conferencing.
- Comprehensive health history review and symptom assessment.
- Medical diagnosis, clinical assessment, and treatment recommendations.
- Prescription issuance for medications available through the Platform, including hormone therapies (Testosterone Spray, Estrogen Spray, Progesterone Spray), GLP-1 Spray, and other medications as clinically appropriate — delivered via Hypospray delivery technology.
- Follow-up consultations and ongoing clinical monitoring.
- Laboratory testing recommendations and result interpretation.
- Coordination of care, including referrals to in-person providers when clinically necessary.
3.3 Asynchronous Consultations. You understand and agree that many consultations conducted through the Platform may be asynchronous (store-and-forward), meaning you submit your health information, medical history, and relevant details through the Platform, and a Clinician reviews this information and responds at a later time. Asynchronous consultations do not occur in real time. Response times may vary based on clinical workflow, Clinician availability, and the complexity of your health needs.
3.4 No Guarantee of Prescription. Completing a health intake, scheduling a consultation, or paying for a membership does NOT guarantee that you will receive a prescription. Clinicians exercise independent medical judgment in determining whether a prescription is clinically appropriate based on your health history, laboratory results, and applicable clinical guidelines.
4. Benefits of Telehealth
4.1 Telehealth Services offer the following potential benefits:
- Convenience. Access healthcare services from your home, workplace, or other preferred location without the need for in-person travel.
- Accessibility. Reduced travel time, fewer scheduling conflicts, and greater flexibility in accessing care — particularly for individuals in rural or underserved areas.
- Timeliness. Faster access to Clinicians and quicker initiation of treatment compared to traditional in-person scheduling.
- Continuity of Care. Ongoing, consistent access to your healthcare provider through the Platform for follow-up consultations and monitoring.
- Privacy. Ability to conduct consultations in a private setting of your choosing.
- Reduced Exposure. Minimized exposure to contagious illnesses in waiting rooms and clinical settings.
- 5. Risks and Limitations of Telehealth
5.1 While telehealth is a safe and effective method of delivering healthcare for many conditions, you acknowledge and understand the following risks and limitations:
- Limited Physical Examination. Telehealth Clinicians cannot perform hands-on physical examinations, palpation, auscultation, or use certain diagnostic instruments. This may limit the Clinician's ability to diagnose or treat certain conditions.
- Technology Dependence. Telehealth requires a reliable internet connection, compatible hardware (computer, smartphone, or tablet), and functioning audio/video capabilities. Technical difficulties including poor connectivity, software malfunctions, power outages, or equipment failures may interrupt, delay, or prevent your consultation.
- Information Limitations. The Clinician's assessment may be based on incomplete information if you are unable to adequately describe symptoms, provide clear images, or if technology limitations affect communication quality. The absence of a physical examination may lead to errors in diagnosis or treatment recommendations.
- Privacy and Security Risks. Although Keen Meds Inc. and our affiliated medical practice implement safeguards to protect your health information, electronic communications carry inherent risks. Unauthorized access, data breaches, or interception of communications may occur despite best efforts. You are responsible for ensuring you are in a private, secure location during consultations and that unauthorized individuals cannot overhear or view your consultation.
- Record Retention. Your telehealth consultation will be documented in your medical record maintained by our affiliated medical practice. Consultations may be recorded for quality assurance and clinical documentation purposes in accordance with applicable law.
- Medication Limitations. Not all medications can be prescribed via telehealth. Certain conditions, medications (including some controlled substances), and clinical scenarios may require an in-person evaluation before prescribing is permitted under federal or state law.
- Clinical Judgment. In some cases, the Clinician may determine that your condition requires an in-person examination or is outside the scope of telehealth. In such cases, the Clinician may decline to provide telehealth services and may refer you to an in-person provider.
- Delayed Response. For asynchronous consultations, there may be a delay between your submission of information and the Clinician's response. If your condition changes or worsens during this period, you should seek immediate in-person medical attention.
- 6. Alternatives to Telehealth
6.1 You have the right to choose alternatives to telehealth, including:
- Traditional in-person medical consultations with a physician or healthcare provider in your area.
- Visiting an urgent care center or emergency room for acute or emergent conditions.
- Consulting with your existing primary care provider or specialist.
6.2 You may request an in-person consultation at any time and are not required to use telehealth services. If you decline telehealth services, you may still seek medical care through traditional in-person channels, though services through the Keen Platform may not be available to you.
7. Technology Requirements
7.1 To access Telehealth Services through the Platform, you will need:
- A device with internet access (computer, tablet, or smartphone).
- A reliable broadband internet connection (minimum recommended speed: 1.5 Mbps for video consultations).
- A current web browser (Chrome, Safari, Firefox, or Edge — latest two major versions recommended).
- For video consultations: a functioning camera and microphone.
- A valid email address associated with your Keen account.
- A private, quiet location where you can communicate without interruption or the risk of being overheard.
7.2 Technical Difficulties. If a technical failure occurs during your consultation, the Clinician or Keen support team may contact you to reschedule. You agree that technical disruptions do not constitute a failure to provide care, and Keen Meds Inc. shall not be liable for delays or interruptions caused by technology failures.
8. Patient Responsibilities
8.1 As a patient receiving Telehealth Services, you agree to:
- Provide accurate, truthful, and complete health information to your Clinician, including your full medical history, current medications, supplements, allergies, and pre-existing conditions.
- Promptly inform your Clinician of any changes in your health status, new symptoms, or adverse reactions to prescribed medications.
- Follow all treatment recommendations, prescribed directions, and medication usage instructions provided by your Clinician.
- Complete required laboratory testing in a timely manner as directed by your Clinician.
- Attend or respond to scheduled follow-up consultations and monitoring requests.
- Notify Keen Meds of any appointment cancellations in a timely manner.
- Maintain the confidentiality and security of your Keen account login credentials.
- Ensure you are in a private, secure location during telehealth consultations.
- Not record telehealth consultations without the prior written consent of the Clinician and Keen Meds Inc.
- Use the Platform responsibly and not for any illegal, fraudulent, or harmful purpose.
- 9. Scope of Services: Hormone Therapy and Hypospray Delivery
9.1 Hormone Optimization Services. Telehealth Services through the Platform may include clinical evaluation and management of hormone optimization therapies, including but not limited to:
- Testosterone Replacement Therapy (TRT) for men and women.
- Estrogen therapy for women.
- Progesterone therapy for women.
- GLP-1 therapy for eligible patients.
9.2 Hypospray Delivery Technology. Products prescribed through the Platform may be delivered using Hypospray spray delivery technology. Hypospray is a proprietary delivery system (not owned by Keen Meds Inc.) that enables convenient medication administration through a spray-based method. You acknowledge that:
- Your Clinician will determine whether Hypospray delivery is clinically appropriate for your treatment.
- You are responsible for using the Hypospray device as directed by your Clinician and in accordance with the medication labeling and instructions provided.
- You will promptly report any device malfunctions, delivery issues, or adverse reactions to your Clinician and to Keen customer support at support@livekeen.co.
9.3 Prescription Fulfillment. If your Clinician issues a prescription:
- The prescription is issued based solely on the Clinician's independent clinical judgment and assessment of your medical needs.
- Prescriptions are filled by our partner pharmacy, an independent licensed 503A compounding pharmacy responsible for compounding, verifying, and dispensing your medication.
- Compounded medications are NOT FDA-approved. They are prepared pursuant to valid, patient-specific prescriptions to meet individual patient needs.
- You are responsible for using prescribed medications as directed and for monitoring and reporting any adverse effects, allergic reactions, or side effects to your Clinician.
- 10. Emergency Procedures
10.1 Telehealth Services are NOT appropriate for medical emergencies. If you are experiencing a medical emergency, a life-threatening condition, or a situation requiring immediate medical intervention:
- Call 911 or your local emergency services number immediately.
- Go to the nearest emergency room or urgent care facility.
- Do NOT rely on the Platform for emergency or time-sensitive medical care.
10.2 Telehealth is not a substitute for emergency care, in-person urgent care, or your primary care physician. The Platform is not equipped to handle emergencies, and delays in seeking appropriate emergency care may result in serious injury or death.
10.3 If a Clinician determines during a telehealth consultation that your condition requires immediate emergency care, you will be directed to call 911 or go to the nearest emergency facility. The Clinician may, at their discretion, contact emergency services on your behalf.
10.4 Crisis and Mental Health Resources. If you or someone you know is experiencing a mental health crisis, suicidal thoughts, or emotional distress, please contact one of the following resources immediately:

These are free, confidential services available 24 hours a day, 7 days a week. The Keen Platform is not a crisis intervention service.
11. Privacy and Confidentiality
11.1 HIPAA Protections. Our affiliated medical practice is a HIPAA-covered entity. Your Protected Health Information (PHI) is protected in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the HITECH Act, and applicable state privacy laws. Keen Meds Inc. operates as a Business Associate under HIPAA pursuant to a Business Associate Agreement with our affiliated medical practice.
11.2 Transmission of Health Information. You acknowledge that telehealth consultations involve the electronic transmission of your health information, including medical history, consultation notes, laboratory results, and prescription information. While administrative, physical, and technical safeguards are in place (including encryption of data in transit and at rest), no electronic transmission is completely secure.
11.3 Your Privacy Responsibilities. You are responsible for:
- Conducting telehealth consultations in a private location where you cannot be overheard or observed by unauthorized individuals.
- Securing your device and internet connection to minimize the risk of unauthorized access.
- Not sharing your account credentials with any other person.

- 12. State-Specific Telehealth Requirements
12.1 Varying State Laws. Telehealth laws and regulations vary by state. The Telehealth Services you receive through the Platform are subject to the laws and regulations of the state in which you are physically located at the time of your consultation.
12.2 State-Specific Consent. Certain states may impose additional requirements for telehealth informed consent, including but not limited to:
- Requirements for an initial in-person visit before telehealth prescribing is permitted.
- Specific disclosures regarding the Clinician's identity, license number, and location.
- Requirements regarding prescribing limitations for controlled substances via telehealth.
- Specific patient rights related to telehealth services.
- Requirements for recording or documentation of telehealth consent.
12.3 Compliance. Our affiliated medical practice maintains compliance with state-specific telehealth laws in each state where its Clinicians are licensed to practice. Where your state requires additional consent disclosures, procedures, or limitations beyond those described in this Consent, the medical practice will provide them as part of the clinical workflow. If applicable state-specific requirements conflict with any provision of this Consent, the state-specific requirements shall control.
12.4 California Residents. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA). Please refer to our Privacy Policy for details.
13. Right to Withdraw Consent
13.1 Voluntary Consent. Your consent to receive Telehealth Services is entirely voluntary. You are not required to consent to telehealth as a condition of receiving any medical treatment, although declining telehealth consent may limit the services available to you through the Platform.
13.2 Withdrawal of Consent. You may withdraw your consent to Telehealth Services at any time, for any reason, by:
- Notifying your Clinician during a consultation.
- Emailing Keen customer support at support@livekeen.co.
- Sending written notice to:

13.3 Effect of Withdrawal. Withdrawal of consent does not affect the validity of any care, consultations, prescriptions, or treatment provided prior to the withdrawal. However, withdrawal may affect your ability to receive ongoing services through the Platform, including prescription refills and follow-up consultations.
13.4 Continuity of Care. If you withdraw consent, your Clinician may recommend a transition-of-care plan, including referral to an in-person provider, to ensure continuity of your medical treatment. You are responsible for arranging follow-up care with an in-person provider if you discontinue telehealth services.
14. Limitations and Disclaimers
14.1 No Guaranteed Outcomes. Keen Meds Inc. and our affiliated medical practice do not guarantee any specific health outcome, treatment result, or therapeutic effect from Telehealth Services. Individual results vary based on numerous factors, including genetics, adherence to treatment protocols, overall health status, and lifestyle factors.
14.2 Technology Disclaimer. Keen Meds Inc. does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Telehealth Services are provided on an "as-available" basis with respect to technology.
14.3 Medical Disclaimer. Keen Meds Inc. is a technology platform and does not provide medical advice, diagnosis, or treatment. All medical services are provided by independent, licensed Clinicians affiliated with our medical practice partner. Information provided on the Platform is for informational purposes only and is not a substitute for professional medical advice.
14.4 Three-Party Liability. You acknowledge and agree that:
- Keen Meds Inc. is responsible solely for the operation of the technology platform, membership management, and coordination services.
- Our affiliated medical practice is solely responsible for all medical decisions, clinical assessments, prescribing, and the quality of clinical care.
- Our partner pharmacy is solely responsible for compounding, dispensing, quality control, and shipping of prescription medications.
- Each party is liable only for its own acts and omissions.
- 15. Relationship to Other Agreements
15.1 This Consent is in addition to, and does not replace, the following agreements and policies, each of which is incorporated by reference:
- Terms and Conditions — governs your use of the Platform and Membership.
- Privacy Policy — governs the collection, use, and disclosure of your personal information.
- HIPAA Notice of Privacy Practices — governs the use and disclosure of your Protected Health Information.
15.2 In the event of a conflict between this Consent and the Terms and Conditions, the Terms and Conditions shall control with respect to Platform use, Membership, billing, and dispute resolution. This Consent shall control with respect to matters specifically related to telehealth informed consent.

Service Partners
The following independent entities provide medical and pharmacy services in connection with the Platform:
Medical Practice. Beluga Health P.A. is the independent medical practice whose licensed Clinicians provide all telehealth consultations, clinical assessments, diagnoses, and prescribing services described in this Consent. Beluga Health P.A. is solely responsible for all medical decisions and the quality of clinical care.
Pharmacy. The Pharmacy Hub is the independent, licensed 503A compounding pharmacy that compounds, verifies, dispenses, and ships prescription medications pursuant to valid, patient-specific prescriptions issued by Beluga Health P.A. Clinicians.
17. Acknowledgment and Consent
BY CREATING AN ACCOUNT ON THE KEEN PLATFORM, COMPLETING A HEALTH INTAKE, OR USING TELEHEALTH SERVICES, YOU ACKNOWLEDGE AND AGREE THAT:
- You have read and understand this Telehealth Informed Consent in its entirety.
- You understand that Keen Meds Inc. is a technology platform and does not provide medical services, diagnoses, or treatment.
- You understand that all medical services, including telehealth consultations, diagnoses, and prescribing, are provided by licensed Clinicians affiliated with our independent medical practice partner (identified in Section 16).
- You understand the nature, benefits, risks, and limitations of telehealth as described in this Consent.
- You understand that telehealth consultations may include asynchronous (store-and-forward) communications and that real-time consultations are not always required or available.
- You understand that Telehealth Services are NOT appropriate for medical emergencies and that you should call 911 or go to the nearest emergency room in an emergency.
- You understand that a prescription is not guaranteed and that prescribing decisions are based solely on the Clinician's independent medical judgment.
- You consent to receive Telehealth Services from Clinicians affiliated with our medical practice partner through the Keen Platform.
- You consent to the electronic transmission of your health information as necessary to facilitate your care.
- You understand your right to withdraw this consent at any time, as described in Section 13.
- You have had the opportunity to ask questions about telehealth and have received satisfactory answers.
